HONOURABLE JUSTICE G. SRI DEVI I.A.No.4 of 2020 In/and CRIMINAL PETITION No. 1283 of 2020 ORDER:

1) The petitioners, who are accused Nos.1 to 4 in Crime No.812 of 2019 of Jeedimetla Police Station, Cyberabad, filed this Criminal Petition under Section 482 Cr.P.C. to quash the proceedings in the above crime, which was registered against them for the offences punishable under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

2) Along with the Criminal Petition, I.A.No.4 of 2020 came to be filed by the petitioners to record the compromise. Along with the petition, a joint memo which is signed by the parties and their counsel, photographs of the parties and Photostat copies of their Aadhar Cards came to be filed. It is stated in the affidavit that at the intervention of elders and well wishers, the parties have settled their disputes in terms of the Memorandum of Understanding, which is filed along with the main Criminal Petition. As per the Memorandum of Understanding, both the parties have agreed to file an application under Section 13-B of the Hindu Marriage Act, 1955 and to obtain a decree of divorce by mutual consent. The 1st petitioner/ husband has agreed to pay Rs.18.00 lakhs to the first respondent towards permanent alimony, out of which a sum of Rs.6.00 lakhs has already been paid on the date of execution of Memorandum of Understanding by way of

demand draft and out of the remaining amount of Rs.12.00 lakhs, Rs.4.00 lakhs has been agreed to pay on the date of signing on the mutual consent divorce petition and the remaining amount of Rs.8.00 lakhs will be paid at the time of final judgment. Both the parties have agreed that there shall not be any claims or counter claims against each other.

3) Today, both the parties are present before this Court and they were identified by their respective counsel. This Court, when examined, both the parties have stated that at the instance of the elders, they have settled the matter out of the Court and the first respondent has further stated that she has already received Rs.6.00 lakhs at the time of execution of Memorandum of Understanding and she has no objection for quashing the proceedings against the petitioners.

4) In the light of the compromise arrived at between the parties, the compromise memo filed by both the parties is recorded and I.A.No.4 of 2020 is ordered.

5) Accordingly, the Criminal Petition is allowed in terms of compromise, and the proceedings in Crime No.812 of 2019 of Jeedimetla Police Station, Cyberabad, against the petitioners/ accused Nos.1 to 4 are hereby quashed.
