HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CIVIL REVISION PETITION No.4480 of 2015 ORDER:

Heard both sides and perused the grounds of revision and the impugned order of the lower Court dated 24.06.2015 in I.A.No.499 of 2014 in O.S.No.260 of 1998, which is suit for partition filed by 12 plaintiffs filed against the 15 defendants, among them defendant Nos.1 to 14 are stated to be the family members of the plaintiffs and the suit once dismissed for default, the application is filed in seeking to restore the suit for delay condonation of 3779 days, that was dismissed by the lower Court covered by the impugned order in the revision. A perusal of the order no way requires interference.

Having regard to the above, the Civil Revision Petition is dismissed. However, if the suit is otherwise maintainable by others, it is not a bar.

Consequently, miscellaneous petitions, if any shall stand closed. No costs.
