ORDER :

On the allegation of un-authorized absence, disciplinary proceedings were initiated against the petitioner, and by order dated 07.06.2016, he was removed from service as Home Guard. Aggrieved by the order of removal, petitioner preferred appeal to the appellate authority (IGP, Home Guards), on 03.11.2016, a copy of which is filed at page nos.31 and 32. It seems that he made representations to the other authorities also. Alleging inaction on the said representations and challenging the order of removal from service, this Writ Petition is filed.

Though learned counsel for petitioner sought to contend that procedure was not followed before issuing the order of removal and the absence of petitioner is not deliberate and willful, and with the permission, as petitioner intends to improve his employment prospective by writing Public Service Examination, the same was not appreciated, learned counsel for petitioner fairly submits that remedy of appeal is available and petitioner has already availed. 3.

Since petitioner has already availed remedy of appeal and according to learned counsel for petitioner, appeal is yet to be disposed of, without expressing any opinion on merits, Writ Petition is disposed of, directing the appellate authority to pass orders in the appeal filed on 03.11.2016, if the same is already acknowledged and is not disposed of, within a period of eight weeks from the date of receipt of copy of this order. Pending miscellaneous petitions shall stand closed.
