The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue writ or direction more particularly one in the nature of writ of mandamus declaring the action of the second respondent in not considering the representation dated 23.04.2018 as illegal arbitrary and unjust and violation of Article 14 of the Constitution of India and consequently direct the second respondents 2 to 4 to consider the representation dated 23.04.2018 and initiate necessary action in accordance with law and pass such other order or orders as this Hon'ble Court may deem fit just and proper in the circumstances of the case." Perusal of the representation dated 23.4.
2018 made by the petitioner demonstrates that he claimed to be in possession of the land admeasuring Ac.2-14 guntas in Sy.No.35/E of Shivareddypet Village, Vikarabad Mandal, Vikarabad District, since 1980. He further claimed that some unknown persons were interfering with his possession over the subject land and they were taking steps to secure mutation in their favour by filing false, forged and fabricated documents. It is on this basis that the petitioner sought a direction from the District Collector, Vikarabad to the Tahsildar, Vikarabad, not to effect any mutation. It may be noted that the so called unknown persons who are interfering with the petitioner's peaceful possession are said to have created documents, allegedly executed by the petitioner himself. This claim, on the face of it, appears to be farfetched.
The petitioner has not taken the trouble to implead any third party who is either interfering with his possession or taking steps to secure mutation. On the strength of these vague allegations, the petitioner cannot expect the revenue authorities to undertake an enquiry.
acts on the part of private parties adversely affecting his civil rights. Leaving it open to the petitioner to do so, this Writ Petition is dismissed. Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
