THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 3780 OF 2017 O R D E R :

This Writ Petition has been filed seeking a mandamus to declare the action of the respondents in not including 1% towards labour cess in respect of the works allotted to the petitioner vide agreements dated 24.10.2013 and 20.04.2015, as illegal and arbitrary.

It is represented that this Court, in somewhat similar circumstances, while disposing of Writ Petition No. 19636 of 2012, through the order dated 02.07.2012, issued the following directions:

1) The respondents shall include 1% cess in the estimates for the works which they propose to undertake, if the work continues for or beyond twelve months and involves engagement of 10 workers or more; and 2) The respondents shall not deduct any amount towards cess, unless the corresponding amount is included in the estimates.

Hence, this Writ Petition is also disposed of in the same terms. No costs.

Registry is directed to append a copy of the order dated 02.07.2012 in Writ Petition No. 19636 of 2012 to this order. The miscellaneous Applications, if any shall also stand disposed of.
