ORAL ORDER:

Petitioner is working as Assistant Grade I in Telangana State Civil Supplies Corporation Limited. At the relevant point of time, petitioner was working at Hyderabad. By the order impugned, petitioner is transferred to newly formed Jayashankar District. Petitioner challenges the same on the ground that he was disturbed in the middle of the academic year; that his daughter is prosecuting 10th class; that he was only recently brought to Hyderabad on a request made by him and within short period, he is transferred. 2.

Ordinarily, these contentions do not merit consideration. Short tenure and other personal inconveniences cannot come in the way of regulating the administrative work of the corporation. In paragraph 5 of the counter affidavit, deponent to the counter affidavit states that on account of formation of new districts, there is increase in requirement of personnel in various new districts. On assessment of the available staff in erstwhile Warangal district, it was noticed that there was shortage of staff, therefore there is requirement of strengthening the organization in the newly formed districts carved out from the existing Warangal district. On the contrary, corporation noticed that there is excess staff working in Hyderabad district.

Further, it is stated that wherever there are procurement operations, man power is required and there is no procurement operations in Hyderabad district. These are sufficient justifications to affect transfer. Prima facie, I do not see any illegality in the transfer affected against the petitioner. However, it is seen that this Court by order dated 3.11.2016 suspended the order of transfer and petitioner continues to work in Hyderabad.

Learned counsel for petitioner submits that petitioner is in the reckoning for promotion and promotions are likely to be taken up shortly. Thus,

at this stage, even before promotions are taken up, if petitioner is disturbed, it would cause lot of hardship and suffering.

Having regard to the fact that petitioner is being continued in the present place, petitioner is granted liberty to ventilate his grievances before the Vice Chairman and Managing Director of the respondent corporation within a period of 10 days from today and the same shall be considered within a period of two weeks thereafter. For a period of four weeks from today, the order of transfer shall not be given effect to. If petitioner does not make any representation within 10 days from today, it is open to the respondent corporation to give effect to the order of transfer. 5.

Subject to above direction, writ petition is disposed of. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed.
