HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.3823 of 2020 ORDER :

The case of the petitioner is that the 4th respondent who has financed the subject vehicle took forcible possession of the same and at the instance of 4th respondent, the 2nd and 3rd respondent are transferring the subject vehicle in favour of third parties. As such, the Deputy Transport Commissioner and Secretary, RTA, Nalgonda has issued notice dated 08-022020 to the petitioner calling for personal hearing. Aggrieved by the action of the 4th respondent, the present writ petition is filed.

Learned counsel for the petitioner submits that the subject vehicle was forcibly taken by the 4th respondent and the 3rd respondent cannot transfer the same in favour of third parties at the instance of the 4th respondent without following due procedure.

Heard learned Assistant Government Pleader for Transport, who, submits that already petitioner was issued notice dated 08-02-2020 instead of filing objections to the same, the present writ petition is filed by him. It is to be seen that already the petitioner was issued notice and he received the same. In view of the same, it is open for the petitioner to file objections to the said notice within two weeks from today and on such submission, the

respondents are directed to consider the said objections in accordance with law and take further action. Accordingly, the writ petition is disposed of. No costs. As a sequel, miscellaneous applications pending, if any, shall stand closed.
