HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7105 of 2017 ORDER:
Heard learned counsel for the petitioners/A2 and 3 and also learned Public Prosecutor representing the State. A perusal of the First Information Report registered for the offences punishable under Sections 323, 506 and 498-A IPC and under Sections 3 and 4 of the Dowry Prohibition Act, shows allegations of threatening with dire consequences and beating with hands.
There is nothing to show of any medical certificate much less any apparent physical injuries to give exception to the guidelines of the latest two Judge Bench expression of the Apex Court in Rajesh Sharma & Others Vs. State of U.P. & Another), in Crl.A.1265 of 2017 (SLP (Crl.) No.2013 of 2017 dated 27.07.2017. In view of the guidelines of the Apex Court supra, this is a fit case to refer the matter to the Committee for report to consider any reconciliation.
Having regard to the above and as per the directions of the Apex Court, the Criminal Petition is disposed of while directing the Investigation Officer to investigate, but not to arrest the petitioners unless report of the Committee on its constitution is received, however this does not prevent the securing for interrogation as part of investigation.
