THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.15107 of 2015 AND CONTEMPT CASE No.1057 of 2015 ORDER:
The Writ Petition and the Contempt Case are being disposed of by this Common order.
2. The Writ Petition was filed challenging the action of respondents 1 and 2 in not sending the petitioner's hall ticket and thereby preventing the petitioner from appearing and writing the examination.
3. The case of the petitioner is that he belongs to Scheduled Caste community. He completed Post-Graduate in the month of May, 2011 and it is sufficient for the entrance test conducted by the respondents pursuant to the notification published in January, 2015 for various vacancies.
Even though the petitioner applied for the post of Management Trainee (Personnel), E-2 Grade, with Post-Graduate degree with specialization in Welfare Administration in Public Administration, no hall ticket was issued to him. In view of the nature of the relief sought and the approaching examination, this Court passed an order on 28.05.2015 as follows:
" There shall be a direction to the respondents to consider the application of the petitioner for issuance of hall ticket and allow him to appear and write examination for the post of management Trainee, if he is otherwise qualified in all respects." 4.
Thereafter, it appears that the respondents passed an order on 30.05.2015 as follows:
" You have submitted application dt.30.05.2015 requesting to issue hall ticket and permit your candidature for the post of 'Management Trainee (Personnel)', pursuant to the Hon'ble High Court Order dt.28.5.2015 in WPMP.No.19588 of 2015 in WP.No.15107 of 2015, the gist of which is as under: "There shall be a direction to the respondents to consider the application of the petitioner for issuance of hall ticket and allow
him to appear and write examination for the post of management Trainee, if he is otherwise qualified in all respects." In line with the above order, your application has been examined and it is to inform that you have submitted online application with Reg.No.07/0000008, and also hard copy in response to the Notification No.01/2015, dt.8.2.2015/11.2.2015 for the post of Management Trainee (Personnel). In this regard, the required qualification for the post of Management Trainee (Personnel) as specified in the Notification No.01/2015, dt.8.2.2015/11.2.2015 is as under: "Graduates with at least Two Years full-time Post Graduate Degree/P.G.
Diploma/Post-Graduate Programme in Management with Specialisation in HR/Industrial Relations & Personnel Management or MHRD or MBA Specialisation with HR (Major) or Master of Social Work with Specialiation in HR from recognised Indian University/Institutes with minimum 60% marks" On perusal of your application and documents reveal that you have submitted your educational qualification as Bachelor of Commerce and Bachelor of Law from Sri Krishnadevaraya University and Osmania University respectively, without enclosing the requisite qualification testimonial as stated above. Hence, your candidature for the post of 'Management Trainee (Personnel)' has not been considered.

The petitioner filed the present Contempt Case alleging nonimplementation of the order of this Court dated 28.05.2015 and the respondents filed a counter-affidavit stating that they have already passed an order on 30.05.2015 rejecting the candidature of the petitioner as he did not enclose the requisite qualification certificates along with application.
6. In view of the non-submission of requisite qualification certificates along with the application for the entrance test, this Court does not find any illegality in passing the order dated 30.05.2015 and not allowing the petitioner for the entrance test.
7. In the circumstances, without going into the merits with regard to the eligibility or otherwise of the petitioner for the entrance test, this Writ
Petition is dismissed on the ground of non-enclosing the requisite qualification certificates along with application. In that view of the matter, the Contempt Case is also does not need any examination and is accordingly dismissed. No order as to costs.
