THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT CIVIL REVISION PETITION No.5579 OF 2016 ORDER:

Vide the present petition, the petitioner has assailed the order dated 03.09.2016 passed in I.A.No.292 of 2016 in O.S. No.596 of 2014 by the II Additional Senior Civil Judge (FTC), Guntur.

The respondent herein is the plaintiff in O.S.No.596 of 2014. He filed the above named IA No.596 of 2014 before the Court below under Order VI Rule 17 and Section 151 of CPC seeking to take on record his surname as 'Kunjeti' instead of 'Kundate'. He states that the petitioner nowhere in the proceedings gave his surname but filed his Aadhar card during the course of trial, and not earlier without giving opportunity to the respondent. Thus, the respondent herein was constrained to file the above named I.A. at that stage when Aadhar card of the petitioner was marked during his chief examination. Accordingly, the respondent prayed that he may be permitted to substitute his surname as 'Kunjeti' @ Kundati @ Kundeti'.

By the said amendment, there is no effect on the relief sought for. It is admitted fact that the surnmae of his father is also 'Kunjeti @ Kundati @ Kundeti' and address is also same. Therefore, I find no illegality or perversity in the order dated 03.09.2016 passed by the Court below.

Finding no merit in the instant petition and the same is accordingly dismissed.

There shall be no order as to costs.
