HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No.3204 of 2018 Order:

The petitioner claims to be the owner and possessor of land admeasuring Ac.1-00 gts., in Survey No.428/12 and Ac.0-20 gts., in Survey No.428/14, totally admeasuring Ac.1-20 gts., situated at Kondapur village, Medipally Mandal, Jagtial District. She claims to have purchased the said land from the original pattadar through a simple sada sale deed dated 23.04.2008. She states that she purchased the land after perusing the Pahanies and other documents. While so, the Tahsildar, Medipally Mandal issued proceedings to the vendor of the petitioner on 19.06.2017 stating that the said land is an assigned land assigned in favour of one Pendem Mallaiah. No notice was issued to the petitioner. Though the petitioner submitted a representation, the Tahsildar did not consider the same. In those circumstances, she filed W.P.No.

26308 of 2017 and the same was dismissed by giving liberty to the petitioner to prefer an appeal. Now the petitioner preferred an appeal before the third respondent in August 2017 and when no further proceedings are taken in the pending appeal, the present Writ Petition is filed.

In view of the pendency of the appeal before the third respondent, this Court is not inclined to go into the merits of the case. Accordingly, the Writ Petition is disposed of directing the third respondent to consider the appeal, preferred by the petitioner in August 2017 against the order passed by the Tahsildar, Medipally Mandal on 19.06.2017, and pass appropriate orders in accordance with law within a period of three (3) months from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed.
