Aggrieved by the grant of compensation of Rs.3,80,000/- by the III Additional Chief Judge, City Civil Court, Hyderabad, vide order, dated 05.07.2004, passed in O.P.No.1230 of 2001, as against the total claim of Rs.15,00,000/-, the New India Assurance Company Limited-respondent No.2 preferred this appeal under Section 173 of the Motor Vehicles Act, 1988 ('the Act', for brevity). 2.
During the course of hearing, it is submitted by learned counsel for the respondent No.1-claimant that respondent No.1 herein-claimant preferred an appeal in C.M.A.No.3593 of 2004 seeking enhancement of compensation and this Court partly allowed said the appeal by enhancing the compensation vide Judgment, dated 13.06.2018.

Since the appeal filed by respondent No.1 herein is partly allowed, the present appeal filed by the National Insurance Company is dismissed as infructuous.
Miscellaneous Petitions pending, if any, shall stand closed. No order as to costs.
