THE HON'BLE SRI JUSTICE P. KESHAVA RAO CRIMINAL REVISION CASE No.497 of 2011 ORDER:

Heard the learned counsel for the petitioner. Pursuant to the order dated 7.7.2011 of this Court, notices taken out on the respondents 1 and 2 are served on 26.7.2011 and to that effect an endorsement is made on the notice sent to the respondents vide R.No.819 dated 22.7.2014. The same is made part of the record. The present Criminal Revision Case is filed challenging the judgment in C.C.No.162 of 2010 dated 26.10.2010 on the file of the V Additional Judicial Magistrate of I Class, Nellore, in dismissing the complaint for default.

However, against the acquittal of the respondents 1 and 2 an appeal lies under Section 378 Cr.P.C. Therefore, the Criminal Revision Case is dismissed. As such, liberty is given to the petitioner to file an appeal, if he desires so. Registry is directed to return the certified copy of the impugned order to the learned counsel for the petitioner.
