HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.20990 of 2016 ORDER:

This Writ Petition is filed challenging the G.O.R.T.No.172, dated 03.03.2016 issued by the 1st respondent for appointing the 5th respondent as District Panchayat Officer, Rangareddy District. When the matter is taken up for hearing learned Government Pleader brought to the notice of this Court that on earlier occasion the same petitioner had filed W.P.No.13990 of 2016 seeking similar relief and for the reasons best known to him, he has withdrawn the said writ petition and this Court dismissed the same by an order dated 25.04.2016. Learned Government Pleader has placed on record a copy of the order passed in W.P.No.13990 of 2016. A perusal of the order dated 25.04.2016 in W.P.No.13990 of 2016 discloses that the said writ petition was dismissed as withdrawn and the petitioner did not seek any leave for filing fresh writ petition while withdrawing the writ petition.

In view of the Order XXIII Rule 1 of the C.P.C as the petitioner did not seek any leave to file a fresh writ petition, the present writ petition is not maintainable. Accordingly, the Writ Petition is dismissed. There shall no order as to costs. Consequently, miscellaneous petitions pending, if any, shall also stand dismissed.
