THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO. 1188 OF 2018 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner-accused to quash the docket order dated 24.10.2017 in Crl.M.P. No.2060 of 2017 in C.C. No.725 of 2014 on the file of the II Additional Judicial Magistrate of First Class, Nellore, whereby the learned Magistrate dismissed the petition filed by the petitioner-accused under Section 45 of the Indian Evidence Act, 1872 to send the admitted signatures of respondentcomplainant along with Ex.D3-receipt to expert for comparison and opinion.

Heard the learned counsel for the petitioner and perused the record. There is no representation on behalf of respondent No.2-complainant.

Having argued the matter for some time, learned counsel for the petitioner would submit that unnecessarily the proceedings in the case are being protracted, which is causing hardship to the petitioner. As seen from the record, it is not appropriate to quash the impugned order. However, it is the right of the parties to ask for expeditious disposal of the criminal proceedings. In view of the circumstances stated, the learned II Additional Judicial Magistrate of First Class, Nellore is directed to dispose of C.C. No.725 of 2014, within 3 months from the date of receipt of a copy of this order. Registry is directed to communicate copy of this order within 7 days from today.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
