Heard the learned counsel for the petitioner. The present Criminal Revision Case is filed by the petitioner/ Accused No.1, challenging the orders passed in Crl.M.P.No.5052 of 2011 in C.C.No.354 of 2011 dt.30.7.2013 on the file of the Court of the III Additional Judicial Magistrate of First Class, Tirupati, dismissing the petition filed under Section 468 (c) of Cr.P.C. seeking discharge of the petitioners therein on the ground that cognizance was taken after lapse of period of limitation.
The facts in brief are that the petitioner along with three others, has been charged for the offence under Sections 342, 379 and 506 IPC read with 34 IPC.
Learned counsel for petitioner, after arguing for some time, seeks permission of this Court to withdraw the Criminal Revision Case with liberty to move an appropriate application before the Court below seeking discharge.
Acceding to the said request, Criminal Revision Case is dismissed as withdrawn with a liberty to move an appropriate application for discharge, before the Court below, and on filing of such application, the learned Magistrate is directed to dispose of the same as per law. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
