THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL APPEAL No.1649 OF 2009 JUDGMENT:

This appeal, under Section 374 (2) of the Code of Criminal Procedure, (for short, 'Cr.P.C') is filed by the appellant/accused aggrieved by the judgment, dated 06.07.2009, rendered in Sessions Case No.729 of 2008 on the file of IV Additional Sessions Judge, Ranga Reddy District, whereunder and whereby, the learned Sessions Judge convicted the appellant/accused for the offences punishable under Sections 354 and 323 IPC and accordingly, he was sentenced to undergo rigorous imprisonment for a period of five years and to pay fine of Rs.1000/-, in default to suffer simple imprisonment for six months for the offence punishable under Section 354 IPC and further he was sentenced to undergo rigorous imprisonment for a period of one year and to pay fine of Rs.500/-, in default to suffer simple imprisonment for three months for the offence punishable under Section 323 IPC. The learned Judge also directed that both the sentences shall run concurrently.

Heard learned counsel for the appellant and the learned Additional Public Prosecutor appearing for the respondent-State. Perused the record.

As seen from the record, no interim bail was granted to appellant during pendency of the appeal. It is brought to the notice of this Court that from the date of pronouncement of impugned judgment, the appellant is in jail and serving the sentence of imprisonment. The impugned judgment was passed

on 06.07.2009. It appears that the appellant had served the entire sentence of imprisonment imposed by the Court below. 4.

Under these circumstances, the appeal is dismissed as infructuous.

Miscellaneous Petitions, if any, pending in this appeal shall stand closed.
