HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION Nos. 3717, 3742, 3900 and COMMON ORDER:

Since the subject matter of all these writ petitions is one and the same, all the writ petitions are heard together and disposed of by this common order.

These writ petitions are filed challenging the impugned order in Roc.No.383-II/2015(A)-130, dated 24.04.2016 passed by the 4th respondent, mainly on the ground that though the petitioners submitted explanations on 12.10.2015 to the show cause notice dated 01.10.2015, the impugned order is passed stating that the petitioners have not submitted any explanation. Learned counsel for the petitioners submits that the impugned order does not reflect the explanation filed by the petitioners to the show cause notice dated 01.10.2015. Heard learned Assistant Government Pleader for Revenue. The postal acknowledgment receipt filed by the petitioners along with the writ affidavit shows that the petitioners sent explanation and the 4th respondent received the explanation filed by the petitioners. As such, without going into the merits of the case, only on the ground of violation of principles of natural justice the impugned order is liable to be set aside.

In view of the above, it is open for the petitioners to file copy of the explanations, again, before the 4th respondent, within a period of two (2) weeks from today, and on receipt of the said explanations the 4th respondent is directed to consider the same and pass final orders, in accordance with law, after giving opportunity of hearing to the petitioners. Till passing of final orders by the 4th respondent, there shall be stay of dispossession of the petitioners from the subject land. Accordingly, these writ petitions are disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petitions, shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 06.02.2017 tk
