HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.3882 of 2019 ORDER:
The prayer of the petitioner in this case reads as under:- For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent in not conducting survey of the land admeasuring Ac.1.26 Guntas in Sy.No.6 situated at Laxmidevipally Village and Mandal as illegal, arbitrary, unjust, unreasonable and Contrary to Article 14 of the Constitution of India and consequently direct the 3rd respondent to conduct survey and demarcate the land admeasuring Ac.1.26 Guntas in Sy.No.6 situated at Laxmidevipally Village and Mandal duly considering the F-line petition dated 27.09.2018 made by the petitioner immediately in the interest of justice and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."
Learned Assistant Government Pleader for Revenue, State of Telangana, appearing for the authorities, informed this Court that the request of the petitioner for conducting a survey of the subject land was already turned down and sought time to produce the evidence thereof.
Today, the learned Assistant Government Pleader would place before this Court a copy of the check slip for F-line petition dated 27.9.2018 issued by the Tahsildar, Laxmidevipally Mandal, Bhadradri-Kothagudem District, wherein it was endorsed on 20.12.2018 that as documentary evidence was not produced in terms of the Circular dated 22.8.2012 of the Commissioner of Survey and Land Records, Hyderabad, the request of the petitioner for survey of the subject land was rejected.
SK, J WP No.3882 of 2019 Dt:07.3.2019 In the light of the aforestated development, the grievance of the petitioner as to the inaction of the revenue authorities upon his F-line petition dated 27.9.2018 stands settled. It is open to the petitioner to make an application afresh along with the required documentary evidence in the event he seeks to renew his request for survey of the subject land.
The Writ Petition is accordingly dismissed.
Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
