THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.16613 OF 2009 ORDER:

This Writ Petition is filed seeking to declare the order, dated 02.01.2009, passed by respondent No.4 - Tahsildar, Hayathnagar Mandal, as confirmed by order, dated 06.07.2009, passed by the Revenue Divisional Officer, Ranga Reddy East Division, Hyderabad, as illegal and arbitrary and consequently, direct the respondents not to resume the land in Survey No.38/1 of Munuganoor Village, Hayathnagar Mandal, Ranga Reddy District.

2. Heard both sides.

3. It is submitted by the learned counsel for parties that against the impugned order, dated 06.07.2009, passed by the Revenue Divisional Officer, Revision Case No.E4/4005/2009 is preferred before respondent No.2 - Joint Collector, Ranga Reddy District, and the same is pending consideration.

4. This Court, by order, dated 12.08.2009, passed an interim order, which reads as follows:

"In the facts and circumstances of the case, there shall be status quo as to the nature of the land and

W.P.No.16613 of 2009 ARR,J under the A.P. Assigned Lands (Prohibition of Transfers) Act, 1977 in the year 2009 and relied on the judgments of this Court in Joint Collector, Ranga Reddy District and others v. P. Harinath Reddy and others1 and Letter sent from Plot No.338, Parvant Nagar, Borbanda, Hyderabad and others v. Collector & District Magistrate, Ranga Reddy District at Hyderabad and others2, since revision is pending before respondent No.2, it is for the petitioner to raise all the contentions before respondent No.2, who shall consider the same and dispose of the revision, after giving an opportunity of hearing to the petitioner.

In view of the same, without going into merits of the case, respondent No.2 is directed to dispose of the revision pending before him within a period of four weeks from the date of receipt of a copy of this order, after giving an opportunity of hearing to the petitioner. Till disposal of the revision pending before respondent No.2, interim order, dated 12.08.2009, shall continue.

7. With the above direction, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. There shall be no order as to costs.
