THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.3288 of 2018 ORDER:

The petitioners state that they are absolute owners, possessors and enjoyers of agricultural landed property to an extent of Ac.0.33 cents each in Survey No.249/28, situated in Ponnada Village, Etcherla Mandal, Srikakulam District, having purchased the same by way of registered Sale Deed, dated 14.06.2016. Since the date of purchase, they are in possession and enjoyment of the same. While so, they submitted an application in Form 6-A on 25.06.2016 for grant of E-pattadar passbooks and title deeds in respect of the above landed property and when no action was taken, the present Writ Petition is filed.

Learned Government Pleader, on the basis of written instructions, submits that one Baggu Rajarao and Baggu Dhanalaxmi filed ATC No.06/2016 on the file of Principal Junior Civil Judge-cum-Special Officer under Tenancy Act at Srikakulam, against the petitioners herein and others to declare them as joint tenant cultivating the subject property. The said ATC is pending consideration before the Court below. Hence, the subject property has been kept in 'Dispute Register' in webland revenue records in view of pendency of civil litigation.

When an application is filed by the petitioners, it is for the third respondent to take appropriate action in accordance with law, after due notice to all the affected parties, but merely because civil proceedings are pending between the parties, he cannot stop the action expected of him under law.

In view of the same, this Writ Petition is disposed of directing the third respondent to pass appropriate orders by considering the application of the petitioners, dated 25.06.2016, by giving due notice to all the affected parties, within a period of three months from the date of receipt of a copy of this order.
