THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No. 27918 of 2013 O R D E R:
The petitioner complains against inaction of 3rd Respondent in registering a crime pursuant to his complaint dated 15.05.2013 as illegal and amounts to refusing to exercise the jurisdiction conferred on 3rd Respondent.

At request of Respondents time was granted on 26.09.2013 to get instructions in the matter. The learned Government Pleader basing on written instructions dated 10.10.2013 submits that the complaint dated 15.05.2013 made by the petitioner was registered as Crime No.243 of 2013 under Sections 448, 427 and 379 read with Section.34 of Indian Penal Code. He prays for dismissal of the writ petition.

A perusal of the written instructions discloses that the 3rd Respondent has enquired into the allegations of the complaint lodged by the petitioner, and has come to the conclusion that the dispute does not warrant further investigation for the dispute between the petitioner and Mr.Prasad etc., is a pure and simple civil dispute with regard to the land in RS.No.3/ 8 and 3/ 7, situated at Ankannagudem village, West Godavari district. Hence, prima facie I am satisfied that the grievance of inaction alleged against the 3rd Respondent could not be made out.

Therefore, the writ petition fails and it is accordingly dismissed. As a sequel, the miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. _____________ S. V. BHATT, J April 18, 2017 Kv
