HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 20709 of 2003 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the 1st respondent in not taking any action for extending the benefit of automatic advancement scheme, pension and for pay fixation etc., as per the service particulars submitted by the 5th respondent pursuant to the instructions issued by the 2nd respondent in proceedings dated 26.07.2002 and 14.05.2003, as illegal and arbitrary. None appeared for the petitioners.

While admitting the writ petition, this Court directed the 1st respondent to consider the case of the petitioners for counting their service rendered in unaided posts for the purpose of granting benefits of automatic advancement scheme as per Act 9 of 2000 as amended in Act 5 of 2002 as per law, if they are otherwise eligible. In view of the interim orders passed by this Court, no further orders are necessary in the writ petition.

Accordingly, the writ petition is closed. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
