M. Pandarinadha Rao v. The State Of Andhra Pradesh Rep.By Its Secretary,
THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M. SEETHARAMA MURTI WRI T PETI TI ON No.34262 of 2016 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) Challenge in this writ petition is to the order dated 17.03.2016 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in M.A.No.200 of 2016 in M.A.No.1666 of 2015 in O.A.No.2178 of 2015. By the said order, the Tribunal dismissed the application filed seeking extension of time to pay the costs as directed earlier on the ground that no valid reason had been established therefor. It appears that the Tribunal condoned the delay of four years three months and seven days subject to payment of costs of Rs.4,000/- to the Andhra Pradesh State Legal Services Authority, Hyderabad, within a time frame under its order dated 20.07.2015 passed in M.A.No.1666 of 2015 in O.A.No.
2178 of 2015. The petitioner/applicant sought extension of time to comply with this order by way of the subject M.A. However, the affidavit filed in support of the M.A. reflects that he explained his inability to pay the amount within the time directed owing to ill-health. However, no details of the so-called ill-health were mentioned and no medical certificate was filed in support thereof. This being the situation, this Court finds no irregularity in the discretionary order passed by the Tribunal refusing to grant extension of time.
The writ petition is devoid of merit and is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
