JUDGMENT:
This appeal is preferred against order dated 19-7-2006 in W.C.No.52 of 2004 on the file of Commissioner for Workmen's Compensation and Assistant Commissioner of Labour, Mahabubnagar.
Respondents 1 and 2 herein submitted application to the Commissioner for Workmen's Compensation claiming compensation of Rs.4,00,000/- for the death of late L.Balreddy. Lower authority on a consideration of contentions and rival contentions of both parties granted a compensation of Rs.2,55,285/-. Questioning the same, Insurance Company preferred present appeal.
When this matter has come up for hearing on 3-6-2016, on the request of advocate for appellant, one week time was granted and thereafter two adjournments were granted on the request of advocate for appellant.
When this matter was taken up on 14-7-2016, there was no representation for appellant and in spite of that, Court accommodated and granted four weeks time and again the matter came up for hearing on 11-8-2016, on that day also, there was no representation for the appellant and three more weeks time was granted and when this matter is listed today, neither appellant advocate present nor any representation is made on behalf of the appellant.
Considering these aspects, I am of the view that appellant is not interested in prosecuting the case and therefore, the same is liable to be dismissed.
Accordingly, C.M.A. is dismissed for non-prosecution. No costs.
As a sequel to the disposal of this appeal, the Miscellaneous Petitions, if any, pending, shall stand dismissed. ____________________ JUSTICE S.RAVI KUMAR Dated 2-9-2016.
