Petitioner is challenging the notice dated 28.09.2018 wherein a provisional assessment is made on the allegation of theft of electricity and pending determination of the civil liability under Section 154 (5) of the Electricity Act, 2003 (for short, 'the Act'), petitioner was directed to pay Rs.7,82,641/-. The notice also indicates that if the petitioner pays 50% of the quantified amount, power supply will be restored.

According to learned counsel for the petitioner, petitioner has already paid Rs.3,50,000/- and is required to pay another Rs.41,321.30 ps. along with supervision charges and reconnection charges.

Since 50% of the quantified amount is not paid, the Writ Petition is disposed of granting liberty to the petitioner to pay the balance of 50% of the amount quantified along with the supervision charges and reconnection charges and on payment of the said amount, power supply shall be restored. If this is complied and power supply is restored, until the proceedings under Section 154 (6) of the Act are concluded and subject to petitioner continuing to pay the electricity charges and complying with all the requirements of power supply, the power supply shall not be disconnected. Pending Miscellaneous Petitions, if any, shall stand closed.
