THE HON'BLE SRI JUSTI CE P.KESHAVA RAO WRI T PETI TI ON No.4042 OF 2020 ORDER:

Heard the learned counsel appearing for the petitioner as well as the learned standing counsel appearing for respondent Nos.2 and 3. 2.

The prayer sought in the writ petition is as under: 'For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue writ or writ of mandamus declaring the action of the respondent no 2 as illegal arbitrary and against the tenets of the RTI Act as the respondent no 2 is not receiving the application under the RTI Act to provide the information as regarding existence of the records related to the property bearing No.8-3-231/F/7/9/A, situated at Krishna Nagar, Kamalapuri Colony, Jubilee Hills Road, Hyderabad, in the interest of justice.'

After hearing both the counsel and from the perusal of the material available on record, it is evident that by letter dated 31.01.2020 the petitioner was informed by the PIO/Deputy Commissioner, Circle-19, Yousufguda, SLP Zone, GHMC, Hyderabad, that the information as sought for by the petitioner relates to Circle-18, Khairthabad, GHMC. Therefore, he was advised to approach the Circle-18, Khairthabad, GHMC. 4.

Learned counsel appearing for the petitioner submits that pursuant to the Letter No.5155/RTI/1/2019/263 dated 31.01.2020, the petitioner would apply to the Deputy Commissioner, Circle-18, Khairthabad, GHMC for obtaining information.

Therefore, the third respondent is directed to consider the application that would be filed by the petitioner within a period of one week from today and pass appropriate orders.

With the above said observation, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
