THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.1623 of 2014 ORDER:
Heard learned counsel for the petitioner as well as learned Government Pleader appearing for respondent Nos.1 to 3. 2.
The prayer sought in the writ petition is as under:- "...to issue a Writ, order or direction and more particularly one in the nature of writ of "Mandamus" declaring the action of the Respondents herein banning and interfering with the business of the petitioner in serving of flavoured Hookahs without reference to rule, law or regulations, being run under the name and style of "Inferno" at Plot No.6, in Sy.No.9/1/H, Green Hills Colony, Kothapet, Hyderabad, is illegal, arbitrary, unconstitutional and contrary to the provisions of the COTP Act and consequently direct the respondents to permit the petitioner to continue his business of serving flavoured Hookahs in his coffee shop without any hindrance or restrictions except under law and pass....." 3.
During the course of arguments, learned counsel for the petitioner, on instructions, informs the Court that the petitioner is not running business of Hookah under the name and style of "Inferno" in view of the ban imposed by the State Government. 4.
Taking the said submission into consideration, this Court is of the opinion that no cause would survive in the writ petition. 5.
Accordingly, the writ petition is closed.
Miscellaneous petitions pending, if any, shall stand closed. No costs.
