Chikka Nageswara Rao, v. The State Of Andhra Pradesh,
THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 3325 of 2018 O R D E R:
The grievance of the petitioners in this writ petition is that the respondents are trying to dispossess them from the houses in question without following due process of law. Learned Standing Counsel for the Gram Panchayat submits that the efforts made by the Gram Panchayat to serve notices on the petitioners did not fructify as they are refusing to receive the same and thereby, the officials of the Gram Panchayat have no other choice other than to take steps in accordance with law.
Learned counsel for the petitioners submits that he would instruct his clients to approach the Secretary, Likithapudi Gram Panchayat, Narsapuram Mandal, West Godavari District and receive the notices and offer their explanation thereto. In the light of the above, the writ petition is disposed of permitting the petitioners to approach the Secretary, Likithapudi Gram Panchayat, Narsapuram Mandal, West Godavari District on or before 14.02.2018 and offer their explanation to the same on or before 07.03.2018. Thereupon, the above said authority shall consider the same and pass appropriate orders, within four weeks thereafter, in accordance with law. Till completion of such
exercise, the petitioners shall not be dispossessed from the houses in question.
Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:06.02.2018 Note: Issue cc in two days.
