THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 16936 OF 2016 O R D E R :

Questioning the inaction on the part of the respondents in considering the case of the petitioner for appointment as a Fair Price Shop Dealer for Venkatapuram Village, Valigonda Mandal, Nalgonda District, on compassionate grounds, in terms of G.O.Ms.No. 4, Consumer Affairs, Food and Civil Supplies (CS-1) Department, dated 28.02.2014, the present Writ Petition has been filed. It is averred in the affidavit filed in support of this Writ Petition that the father of the petitioner who was appointed as a Fair Price Shop Dealer for Venkatapuram Village died due to precarious health condition on 13.09.2015. Thereafter, no fair price shop dealer was appointed for the said village on permanent basis. While so, the petitioner made an Application to the respondents on 08.10.

2015, seeking consideration of his case for appointment as a Fair Price Shop Dealer for the aforesaid village. Further, the petitioner submits that para 6 of G.O.Ms.No. 4, dated 28.02.2014 stipulates certain conditions for appointment of legal heirs of deceased Fair Price Shop Dealers. According to the petitioner, Clauses 6(i) & (iii) of the said G.O. entitles him to be appointed as a Fair Price Shop Dealer, as he is the only legal heir of his father, who died on 13.09.2015. He therefore, requests that his case be considered in terms of G.O.Ms.No. 4, dated 28.02.2014.

Learned Government Pleader for Civil Supplies (Telangana) does not oppose the relief sought for by the petitioner. In that view of the matter, the respondents authorities are directed to consider the Application submitted by the petitioner dated 08.10.2015 seeking appointment as a Fair Price Shop Dealer for the abovesaid village, in terms of G.O.Ms.No. 4, dated 28.02.2014, and dispose it of within a period of eight weeks from the date of a receipt of

a copy of this order.

With this, the Writ Petition stands disposed of. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
