THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.3263 OF 2018 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Home (A.P.) appearing for the official respondents.

When the matter is taken up, written instructions, dated 07.02.2018, furnished by the Sub-Inspector of Police, Kalakada Police Station, Chittoor District are placed on record by the learned Government Pleader for Home. The said instructions read as under:

"It is submitted that one T.Vijaya Kumari 5th respondent lodged complaint with the respondent police against one T.Shiva Reddy, T.Rajamma and T.Surender Reddy, stating that, her marriage was performed with one T.Shiva Reddy about 20 years back. They lived happily 3 years. After that the accused started harassing the petitioner for want of additional dowry. The village elders tried settled the matter but their attitude was not changed, hence she requested to take necessary action against them.

Basing on the same a case in Cr.No.56/2017 registered for the offences U/Sec.498(a), 323 r/w 34 IPC and 3 and 4 of DP Act and investigating into. During the course of investigation 9 witnesses were examined and recorded their statements. The respondent police conducted family counseling but they did not settle the matter. Further the respondent police served 41(a) Cr.P.C. notices to the accused and the same was received by them.

In this case the investigation is completed and charge sheet was file before the Hon'ble Judicial First

Class Magistrate at Vayalpad vide C.C.No.14/2018 on 23.01.2018.

It is further submitted that except registering the case the respondent police never harassing the petitioner as alleged by her. The respondent police never called the petitioner to the police station and they never insisting the petitioner to attend the police station. When the name of the petitioner is not shown in the FIR as accused, calling her to the police station does not arise. The respondent police shall abide the directions if any passed by this Hon'ble Court."

On noticing the same, a request is made by the learned counsel for the petitioner to place the said instructions on record and dispose of the writ petition.

Accordingly, the Writ Petition is disposed of, by placing on record the written instructions, dated 07.02.2018, furnished by the Sub-Inspector of Police, Kalakada Police Station, Chittoor District. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
