THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.3034 OF 2006 ORDER:

This writ petition is filed seeking a declaration against the action of the second respondent in proposing to take physical possession of premises in plot No.5 in R.S.No.226/4 at Rajahmindry as illegal, arbitrary and violative under the provisions of Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. This writ petition was filed in February, 2006 and notice has been ordered by this Court while ordering status quo. There is no representation for the second respondent and no counter affidavit is filed by the second respondent. This is an old matter pertaining to the year 2006 and as such, instead of keeping the writ petition pending, the writ petition is being disposed of giving liberty to the petitioner to seek appropriate legal remedy as and when fresh cause of action arises.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, pending if any, in the writ petition, shall stand closed.
