HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.3477 OF 2009 ORDER:

This Writ Petition is filed seeking to issue Writ of Mandamus declaring the action of the respondent in cancelling the promotion vide Proc.No.A4/6997/2008, dated 06.08.2008 despite the fact that the petitioner possesses the seniority to be promoted as Assistant Engineer, as illegal, arbitrary and violative of Articles 14 and 16 of the Constitution of India.

The matter was admitted on 23.04.2009 and on 25.01.2016 learned counsel for the respondent submitted that pursuant to the interim order dated 29.04.2010 passed by this Court in W.P.M.P. No.4509 of 2009, the case of the petitioner was considered and orders were passed by the respondent rejecting the claim of the petitioner. On that learned counsel for the petitioner sought time to get instructions. Though the matter was posted to 01.02.2016, there was no representation on behalf of the petitioner, hence the matter was posted to 03.02.2016 under the caption "for dismissal". Today also none appeared on behalf of the petitioner.

Hence, the Writ Petition is dismissed for default for nonprosecution. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall also stand dismissed. ____________________________ CHALLA KODANDA RAM, J Dated:03.02.2016.
