THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39857 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 3rd respondent in registering the FIR No.609 of 2015, as illegal and arbitrary.
The main grievance of the petitioner is that the marriage between the 4th respondent and the petitioner took place 28 years back and out of the wedlock three children are blessed and all the three children are well educated and now after 28 years of married life, due to minor differences and ego problems, the 4th respondent, in order to gain upper hand and with oblique motives, lodged the present complaint with the 3rd respondent with false allegations and the 3rd respondent registered the same as FIR No.609 of 2015, dated 08.08.2015, for the offence under Section 498-A IPC.
Considering the grievance of the petitioner, the 3rd respondent is directed to complete the investigation in FIR No.609 of 2015 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 18th November, 2016 KL
