The Fertilizer Corporation Of India v. The State Of Telangana,
THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.26319 of 2017 ORDER:
Heard learned counsel for the petitioner, learned Government Pleader for Mines and Geology (Telangana) for respondents 1 to 3 and learned counsel for respondent No.4.
2.
The grievance of the petitioner in the present writ petition is inaction on the part of respondent Nos.2 and 3 in acting upon its representation dated 26.07.2017 and taking action against respondent No.4 under the provisions of the Telangana State Minor Mineral Concession Rules, 1966.
3.
When the matter is called, it is reported by the learned Government Pleader that respondent No.3 issued a show cause notice dated 16.08.2017 asking respondent No.4 as to why action should not be taken for collection of seinerage fee penalty amount of Rs.87,750/- under Rule 26 of the said Rules and hence, no further orders need be passed in the present writ petition. 4.
In view of the same, this Court deems it appropriate to dispose of the present writ petition with a direction to respondent No.3 to proceed further in accordance with law pursuant to the show cause notice dated 16.08.2017 and pass final orders, after hearing all the stakeholders.
5.
Accordingly, the writ petition is disposed of. Miscellaneous petitions pending, if any, shall stand closed. No order as to costs. ____________________ A.V. SESHA SAI, J Date: 28.08.2017 TJMR
