THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No. 1?29 of 2O24 ORDER:

In this criminal petition, the petitioners, who are accused Nos.l to 3, seek to quash the proceedings against them in C.C.No.946 of 2023 on the frle of I Additional Judicial First Class Magistrate, Nizamabad.

After arguing for some time, when this Court has expressed its opinion stating that the said contentions are disputed questions of fact which need to be gone into by the trial Court, learned counsel for the petitioners restricted his prayer to the extent of dispensing with the presence of the petitioner Nos.2 and 3/accused Nos.2 and 3 before the trial Court.

Hence, the appearance of the petitioner Nos.2 and 3/accused Nos.2 and 3 before the trial Court is dispensed with unless their presence is specifically required during the course of trial, subject to the condition of petitioner Nos.2 and 3/accused Nos.2 and 3 being represented by their counsel on every date of hearing. 4.

Accordingly, the Criminal Petition is disposed of. Pending miscellaneous petitions, if any, in this Criminal Petition shall also stand closed.
