THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION NO.13517 OF 2007 ORDER:

This writ petition is filed seeking to set aside the order dated 16.05.2007 in Revision Petition No.18 of 2006 on the file of the 3rd respondent and restore the Revision Petition to its original position.

The only grievance of the petitioner is that the restoration application which was posted for hearing before the 3rd respondent was rejected for not being present on 20-01-2007. The third respondent has recorded the absence of the Advocate of the petitioner on 20-01-2007 and rejected the restoration petition on 16-05-2007.

It is the case of the petitioner that the Advocate, who was on his way to the office of the 3rd respondent to make a submission on the revision petition, met with motor vehicle accident and was injured.

Considering the above facts and circumstances of the case, the writ petition is disposed of, setting aside the order of the 3rd respondent, directing him to issue notice to the petitioner well in advance, post the matter for hearing and
