Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents.
The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondents 2 and 3 in not taking action, in pursuance of Memo No.30057 /Assign.I(2)/2006-1 dated 03.08.2006 issued by the 1st respondent directing them to submit fresh proposals to the Government for alienation of land admeasuring Acs.2.65 cents in Survey No.9 situated at Bowluwada Village, Anakapalli Mandal, Visakhapatnam District, in favour of the petitioner, as illegal and arbitrary, and consequently, direct respondents 2 to 4 to take appropriate action, in pursuance of the said Memo. Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction to respondents 2 and 3 to submit fresh proposals to the Government, as per the Memo No.30057/Assign.
I(2)/2006-1 dated 03.08.2006 issued by the 1st respondent. Having regard to the circumstances stated above and without going into the merits of the case, the Writ Petition is disposed of, directing respondents 2 and 3 to submit fresh proposals to the Government, as per the Memo No.30057/Assign.I(2)/2006-1 dated 03.08.
1st respondent, if not yet submitted, in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of the order. There shall be no order as to costs. Consequently, miscellaneous petitions if any pending in the writ petition shall stand closed.
