HON'BLE SRI JUSTICE S.V. BHATT W.P. No.24804 OF 2017 ORDER:
Heard Mr.P.M.Mithileshwara Reddy for petitioner and the learned Assistant Government Pleader (Revenue). The petitioner prays for the following relief: "..Writ of Mandamus declaring the action of 3rd respondent in trying to dispossess/demolish the petitioner dwelling house bearing D.No.50/384-B-D-13, Arora Nagar, Revenue Ward No.50, Kurnool by succumbing to the pressures put-forth by the local politicians without following due process of law, as arbitrary, illegal and unconstitutional and consequently direct the respondents not to interfere with the petitioner's peaceful possession and enjoyment of her aforesaid dwelling house..." The Assistant Government Pleader, on instructions, submits that the 3rd respondent admits possession of petitioner of the subject matter of writ petition. The 3rd respondent would follow the procedure in accordance with law if the petitioner is to be evicted from the subject matter of writ petition. The statement is placed on record and accepted.
The petitioner is given liberty to file representation/ reply to the notice the petitioner receives in this behalf and also request for allotting a house-site in any one of the ongoing schemes of the Government. If such a request is made by the petitioner, the 3rd respondent considers the eligibility of petitioner if the petitioner is otherwise is entitled to and passes a comprehensive order. Till such time, the petitioner shall not be dispossessed.
The writ petition is disposed of accordingly. No order as to costs.
