HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE U. DURGA PRASAD RAO WRIT PETITION No.12129 of 2016 ORDER: (Per SKK, J) Vide the present petition, petitioner seeks direction, thereby directing respondents 1 to 5 to produce the petitioner's son by name Perumalla Vijayakanth, aged about 31 years, before this Court and set him at liberty.

As stated in the present petition, respondent No.7 took the son of the petitioner on 24.12.2015 to attend Christmas celebrations in the house of respondent No.6. On 26.12.2015, petitioner, along with his wife called his son Perumalla Vijayakanth on his wife's mobile No.7794980427 approximately about 10.30 p.m., to greet their son, respondent Nos.6 and 7 and their family members for Christmas, however, their phone was not answered. On 27.12.2015, respondent No.6 called the wife of the petitioner from mobile No.9701822138 approximately at about 2.30 a.m., and to their shock and surprise, it was informed by the mother of respondent No.7, i.e., the wife of respondent No.6 that son of the petitioner, i.e. Perumalla Vijayakanth ran away from their home. Thereafter, the petitioner made all efforts to trace his son, however, his whereabouts are not known. At last, he filed the present petition.

This Court by order dated 26.07.2016 directed the respondents to file counter-affidavit.

SKK, J & UDPR, J W.P.No.12129 of 2016 Respondent No.5 has filed counter-affidavit, wherein it is stated that they do not have any information regarding the whereabouts of the son of the petitioner; missing report dated 11.02.2016 was registered at Police Station, Kagaz Nagar and if any whereabouts of the son of the petitioner are known, certainly action will be taken as per law against the responsible persons.

Keeping in view the counter-affidavit filed by the respondents and the assurance given by the learned Asst. Govt. Pleader appearing on behalf of respondents 1 to 5, we hereby close the present petition with the hope that as and when the son of the petitioner is traced, he will be handed over to the petitioner.

Miscellaneous petitions if any pending in the writ petition stand closed.
