HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.3273 of 2018 ORDER:

Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration for respondent No.1 and Sri Ch. Madhu, learned Standing Counsel, offers to appear for respondent Nos.2 and 3 from oral instructions and perused the prayer in the writ petition with supporting affidavit and other material on record.

The prayer in the writ petition reads as follows: "........to issue an appropriate Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the Notice No.616/TPS/C18/GHMC/2018 dated 09.01.2018 of the 3rd respondent as illegal, null, void and arbitrary and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the interests of justice."

Undisputedly, the notice, dated 09.01.2018, is served on the petitioner though it is mentioned as opposite to H.No.8-2-616/3/E/2 without mentioning the house number of the writ petitioner. The petitioner has given his house number in the writ petition for respondents for further correspondence to take note of. Pursuant to the said notice, dated 09.01.2018, the petitioner is directed to submit his explanation within one week from the date of receipt of a copy of this order and the respondents shall consider and pass appropriate order and communicate the same. In the meantime, there shall not

dispossess the petitioner by demolition of the premises in question, however, the petitioner shall not make any improvements. 4.

With the above direction, the writ petition is disposed of. Miscellaneous petitions pending, if any, shall stand closed. No costs.
