HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7723 of 2017 ORDER :

Heard learned counsel for the petitioner/accused of Crime No.110 of 2017 of Station House Officer, Kirlampudi Police Station, East Godavari District, registered for the offences punishable under Sections 409 and 420 IPC and also learned Public Prosecutor representing the State-1st respondent before ordering notice to the 2nd respondent-de facto complainant and perused the grounds urged in the quash petition and contents of the F.I.R.

In fact, from hearing and on perusal, there is nothing to interdict the investigation, leave about Section 420 IPC how far applicable is a matter to be decided after investigation. Needless to say as there is any misappropriation to attract Section 409 IPC. 3.

Accordingly, the criminal petition is disposed of. However, without prejudice to the defence of the petitioner/accused before the trial Court. The police are directed to complete investigation within four months from the date of receipt of a copy of this order. 4.
