Heard Sri Nimmagadda Venkateswarlu, learned counsel for the petitioner and Sri Sampath Prabhakar, learned Standing Counsel for the respondent Municipal Corporation.

A notice bearing No.3546/HS/C-14-15, dated 27.04.2017, issued by the respondent Municipal Corporation under Sections 441, 564 and 622 of Hyderabad Municipal Corporation Act, is under challenge in the present writ petition.

According to the learned counsel for the petitioner, the impugned action on the part of the respondents herein is highly illegal, arbitrary and violative of Article 14 of the Constitution of India besides being opposed to the very spirit and object of the provisions of Hyderabad Municipal Corporation Act, 1955.

It is submitted by the learned Standing Counsel for the Municipal Corporation that the impugned notice dated 27.04.2017 is only a show-cause notice and the petitioner herein has already submitted his explanation and the respondents will consider the same and further action will be taken in accordance with law.

Having heard the learned counsel for the petitioner and the learned Standing Counsel for the Municipal Corporation, this Court deems it appropriate to dispose of the writ petition, with a direction to the respondent Municipal Corporation to consider the representation submitted by the petitioner which was acknowledged by the Municipal Corporation on 15.06.2017 and pass final orders, strictly in accordance with law. Till such
exercise attains finality, no coercive action shall be taken pursuant to the impugned show-cause notice dated 27.04.2017. As a sequel, the miscellaneous petitions, if any, shall stand disposed of. There shall be no order as to costs.
