HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 11174 of 2012 ORDER:

Heard learned counsel for the petitioner and Government Pleader for Revenue. With the consent of both the parties, the main writ petition is heard at the admission stage itself.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction of respondent Nos.3 and 4 in considering the representation of the petitioner dated 26.03.2012 seeking inclusion of his name in the revenue records in respect of land admeasuring Ac.123.00 in Sy.No.85 (old No.194) Patta No.131 of Dhonivanilaxmipuram (V), Nakkapally Mandal, Visakhapatnam, by conducting survey and to demarcate the land, as illegal, arbitrary, contrary to record and violative of principles of natural justice; and consequently direct the respondents to take immediate action on the representation of the petitioner.

The main grievance of the petitioner is that though he made a representation on 26.03.2012 till date the same was not considered. Having regard to the circumstances stated above and taking into consideration the nature of averments made in the writ petition, respondent Nos.3 and 4 are directed to consider the representation dated 26.03.2012 made by the petitioner, if the same is still pending and pass orders in accordance with law within a period of eight (08) weeks from the date of receipt a copy of this order. With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
