P. Vijaya Bharathi, v. Sri. Korivi Mallesham,
IN THE HIGH COURT OF JUDICATURE AT HYDERABAD
FOR THE STATE OF TELANGANA AND THE STATE OF ANDHRA PRADESH FRIDAY, THE TWENTY SECOND DAY OF JULY, TWO THOUSAND AND SIXTEEN
Present
HON'BLE SRI JUSTICE P.NAVEEN RAO Civil Revision Petition No.3507 of 2016 Between:
P. Vijaya Bharathi.
.. Petitioner AND Sri Korivi Mallesham.
.. Respondent
The Court made the following:
THE HON'BLE SRI JUSTICE P.NAVEEN RAO Civil Revision Petition No.3507 of 2016
ORDER
Petitioner/plaintiff filed a petition under Order VII Rule 14 CPC praying the Court to receive the documents, which was rejected by the order impugned.
2. The trial Court considered the plea raised by the petitioner with reference to the justification to bring on record the documents 8 years after institution of the suit. The trial Court noticed that at the stage when the suit was coming up for arguments, petition is filed and no cogent reasons were assigned in causing such undue delay in presenting the documents, more so, when a plea was specifically raised in the suit.
3. I do not see any error in the decision arrived at by the trial Court warranting interference by this Court.
4. The Civil Revision Petition is, accordingly, dismissed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this revision shall stand dismissed. _________________ P.NAVEEN RAO, J 22nd July, 2016 sj
