O R D E R

The case of the petitioner as per the averments made in the affidavit filed in support of the writ petition, is that he was working as Cleaner in the respondent - Telangana State Road Transport Corporation and by proceedings dated 15.01.2010 he was imposed with the punishment of deferment of annual increment for a period of one year with cumulative effect, duly treating the period of suspension, as not on duty. Challenging the same, he filed appeal before the 3rd respondent - Divisional Manager, who is the appellate authority, on 29.3.2010. Aggrieved by the inaction of the 3rd respondent in not considering his appeal, the present writ petition came to be filed.

As per the case of the petitioner he filed appeal during the year 2010 and after a period of seven years, filed the present writ petition alleging inaction on the part of the 3rd respondent. This court is not inclined to entertain the writ petition at this length of time, in the absence of any plausible explanation for the delay in approaching this court on the part of the petitioner. However, as the appeal filed by the petitioner is stated to be pending with the 3rd respondent, it is for the said authority to consider and dispose of the same in accordance with law, if the same has not been already disposed of. With the above observation, the writ petition is disposed of at the stage of admission. No costs. Miscellaneous petitions pending if any, shall stand closed. -------------------------------------- A.
