HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL PETITION No.1501 of 2016 ORDER:

The petitioner, who is the sole accused in Crime No.13 of 2016 of Kamepally Police Station, Khammam District, filed the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with the above crime, registered for the offences punishable under Sections 294 (b), 323 and 354 IPC. The averments in the report would show that on 27.01.2015 at about 12.00 hours while the informant along with her husband were going to cotton field, at that time the petitioner, who was hiding himself in the bushes come out of the bushes, caught hold the tuft of the informant, abused her in filthy language saying that as to why the informant gave evidence against him. It is further alleged that when the informant tried to catch hold of his collar, the petitioner slapped her and tried to rape her.

On hearing the cries of informant, her husband came there and on seeing the husband of the informant, the petitioner ran away by leaving his cell phone and motor cycle. Basing on these allegations the above case came to be registered. Heard learned counsel for the petitioner and Additional Public Prosecutor appearing for the respondent-State. A perusal of the averments in the First Information Report would show the petitioner caught hold of tuft of the informant, slapped and abused her in filthy language. The averments in the report further shows that the petitioner tried to rape her when she tried to catch hold of his collar.

However, the petitioner, if so advised, shall surrender before the Court concerned and make an application for regular bail which shall be dealt with on merits in accordance with law on the same day or at the earliest.
