Heard Mr.Sai Gangadhar Chamarthy for petitioner, Assistant Government Pleader for respondent Nos.1 to 3 and Ravi Chimalapati for respondent No.4.
Petitioner challenges Circular Memo No.A4/6131/2012-5, dated 22.05.2015, issued by respondent No.3, as illegal, arbitrary and violative of provisions of the Panchayat Raj Act, 1994 (for short 'the Act').
Counsel for petitioner requests the Court to permit the petitioner to file revision before the Secretary under the provisions of the Act.
Counsel for respondents do not oppose the request of petitioner.
I am satisfied, having regard to the limited submissions, the writ petition can be disposed of by this order: "The petitioner is given four weeks time from today to file revision before the Secretary under the provisions of the Act, subject to the petitioner paying property tax together with 50% of the enhanced tax. If the revision is filed by complying with the above
condition, the Secretary is directed to examine all the objections, take a decision and communicate the same to the petitioner within three months thereafter."
Writ petition is accordingly disposed of.
