THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.1229 OF 2018 ORDER:

This petition is filed by the petitioner-accused under Section 482 Cr.P.C. to quash the proceedings in Cr.No.63 of 2017 on the file of the Station House Officer, Buggaram Police Station, Jagtial District, which was registered for the offence punishable under Section 3 (1) (r) (s) of SCs & STs (POA) Act.

Heard learned counsel for the petitioner, learned Assistant Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioner would submit that there are civil disputes between the petitioner and Bandari Rajaiah. The complaint was filed at the instance of the said Bandari Rajaiah in this crime.

In view of nature of allegations, it is not appropriate to quash the proceedings. But, in view of the punishment prescribed for the offence alleged, a direction can be given to the S.H.O. as follows:

"The S.H.O. concerned shall not arrest the petitioneraccused and he should investigate the said crime and file charge sheet or final report as the case may be." 5.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
