HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.3916 of 2019 ORDER:

The prayer of the petitioner in this case reads as under:- "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not conducting the survey and fixing the boundaries to the petitioner's lands in Sy.No. 276/J/14 to an extent of Acs.7-00 situated at Chinthalapalem Village and Mandal, Suryapet District as illegal, arbitrary, contrary to the provisions of the Survey and Boundaries Act and the Rules thereunder as well as in violation of the fundamental rights guaranteed under the constitution of India and consequently direct the respondents to conduct the survey and fix the boundaries to the petitioner's above said lands forthwith and to pass appropriate orders forth and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

Perusal of the record reflects that the petitioner submitted an application dated 11.9.2018 in the prescribed format and paid the requisite fee for the survey that she seeks.

Having received such an application, it is not open to the Tahsildar, Chinthalapalem Mandal, Suryapet District, to remain somnolent.

The Writ Petition is accordingly disposed of directing the Tahsildar, Chinthalapalem Mandal, Suryapet District, to take appropriate action upon the petitioner's application dated 11.9.2018 expeditiously and in any event not later than eight weeks from the date of receipt of a copy of this order, be it from whatever source.
